1. Introduction

Welcome to Erik on the Shore. These Terms of Service govern your access and use of our photography services and client galleries hosted on Pixieset . By accessing or using our Pixieset galleries, you agree to comply with these Terms. If you do not agree, you must discontinue use of our services.

2. Services Provided

Erik on the Shore provides surf photography services, including but not limited to:

  • Surf photography sessions

  • Delivery of digital photos via Pixieset galleries

  • The option to download digital images

  • Print purchasing options through Pixieset’s e-commerce feature

3. Client Galleries

  • After your photography session, a digital gallery will be provided via Pixieset for viewing, downloading, and purchasing prints.

  • The gallery will be available for a specified period, typically 30 days, unless otherwise agreed upon.

  • After the gallery expires, access to the gallery or additional downloads may incur a fee.

4. Image Ownership and Licensing

  • Erik on the Shore retains full copyright to all images provided in the gallery, unless otherwise agreed upon in writing.

  • The client is granted a personal use license for downloading, sharing, and printing images. Personal use does not include commercial or third-party distribution without express written consent.

  • Commercial use, including but not limited to advertising or resale of the images, requires a separate licensing agreement.

5. Downloads and Image Quality

  • Digital files provided through Pixieset will be in high resolution suitable for printing.

  • Once the gallery is available, clients may download the images for personal use.

  • Erik on the Shore is not responsible for any loss of image quality due to unauthorized editing, compression, or poor print quality from non-approved vendors.

6. Print Orders and Products

  • Pixieset enables clients to order prints directly from a selection of high-quality printing partners.

  • Prices for prints and products are set by Erik on the Shore and may be subject to change without notice.

  • Shipping and delivery of prints and products are handled by third-party vendors. Any issues with shipping should be addressed to the vendor directly, although we will assist when possible.

7. Payment and Pricing

  • All pricing for digital downloads, prints, and services is outlined in the client gallery and on our website.

  • Payment for products (prints, albums, etc.) must be completed through Pixieset’s secure payment gateway before products are processed and shipped.

  • Refunds for digital downloads are not permitted once files have been accessed. For physical products, refund policies are determined by Pixieset and the respective printing partner.

8. Cancellations and Refunds

  • Cancellations or rescheduling of photography sessions must be communicated at least 48 hours prior to the scheduled date.

  • Deposits or payments made for photography services are non-refundable unless the cancellation is initiated by Erik on the Shore.

  • Refunds for prints or physical products ordered through Pixieset are handled according to the vendor’s terms and conditions.

9. Privacy and Data Protection

  • We respect your privacy. Personal information collected through Pixieset (such as email addresses and billing details) is used solely for communication, delivery of services, and processing payments.

  • We do not share or sell your personal information to third parties, except as required to complete your order (e.g., sharing your address with the print vendor).

10. Use of Client Photos

  • By agreeing to these Terms, you grant Erik on the Shore permission to use images from your session for marketing, portfolio display, and social media purposes, unless otherwise agreed upon in writing.

  • If you wish to keep your images private and not be used for promotional purposes, please inform us in writing before or during the session.

11. Limitations of Liability

  • Erik on the Shore is not liable for any damage, loss, or corruption of images during delivery or hosting on Pixieset. Backup copies of your images are retained for a reasonable period but are not guaranteed after the gallery expiration.

  • In no event shall Erik on the Shore be liable for any indirect, incidental, or consequential damages arising from your use of our services or the Pixieset platform.

  • We are not responsible for issues related to Pixieset’s platform, such as downtime, technical problems, or data breaches. However, we will work with Pixieset to resolve any issues as quickly as possible.

12. Modifications to Terms

  • Erik on the Shore reserves the right to modify these Terms at any time. Any changes will be communicated to clients via email or through a notice on our website.

  • Continued use of our services after any modifications to the Terms constitutes your acceptance of the updated Terms.

13. Governing Law

  • These Terms shall be governed and construed in accordance with the laws of [Your Location], without regard to its conflict of law provisions.
